TERMS AND CONDITIONS OF THE ONLINE STORE FENIX

§1 General Provisions

These Terms and Conditions define the rules for using the Store, placing orders, concluding sales contracts, order fulfilment, payments, delivery, withdrawal from the contract, and the complaint procedure.

The Customer is obliged to read the Terms and Conditions before making a purchase. Placing an order is equivalent to accepting the Terms and Conditions.
§2 Definitions

Seller – Fenix.
-
Customer – any natural person, legal person, or organisational unit without legal personality making purchases in the Store.

Consumer – a Customer who is a natural person making a purchase not directly related to their business or professional activity.

Product – silver jewellery with amber available in the Store.
-
Sales Contract – a distance sales contract concluded between the Seller and the Customer.
-
Business Day – a day from Monday to Friday, excluding public holidays in Poland.
§3 Placing Orders

Orders can be placed via the website 24/7.

To place an order, the Customer must:

select a Product and add it to the cart,
-
fill out the order form,
-
accept the Terms and Conditions and the Privacy Policy,

confirm the order.

After placing an order, the Customer receives an e-mail confirming its receipt.
-
The Sales Contract is concluded when the order is confirmed by the Seller.
§4 Prices and Payments

Product prices are given in Polish zloty (PLN), include VAT and do not include delivery costs.

The Customer may pay:

by traditional bank transfer,
-
via the Shopify Payments system (PayU, Przelewy24, Blik),
-
by debit/credit card.

Payment must be made within 3 business days of placing the order.
-
Failure to make the payment within the deadline results in cancellation of the order.
§5 Order Fulfilment and Delivery

The order fulfilment time is 1 to 5 business days from the moment the payment is credited.

Products are delivered via:
-
courier companies (InPost, DPD),
-
InPost parcel lockers,
-
Polish Post (upon request).
-

Delivery costs and times are specified on the order summary page.

The Customer should check the package upon delivery and report any damage to the courier or delivery provider.
§6 Right of Withdrawal

The Consumer has the right to withdraw from the contract without giving any reason within 14 days of receiving the Product.

To exercise the right of withdrawal, the Consumer must submit an unambiguous statement (e.g., via email or return form).

The Product must be returned unused and in its original packaging.
-
The refund will be made no later than 14 days after the returned Product is received.

The cost of return shipping is borne by the Consumer.
§7 Complaints and Warranty

All products offered in the Store are new and free from physical and legal defects.

Complaints may be submitted via e-mail to: info@fenix-jewellery.com.

The complaint should include Customer details, a description of the defect, and proof of purchase.

The Seller will review the complaint within 14 days of receiving it.

If the complaint is accepted, the Seller will replace or repair the product, or issue a refund.
§8 Personal Data and Privacy Policy (GDPR)

The administrator of personal data is Fenix, located at ul. Tysiąclecia 9, 80-351 Gdańsk, Poland.

Personal data is processed solely for purposes related to order fulfilment and customer service.

The Customer has the right to access, correct, and request deletion of their data.

Detailed information is provided in the Privacy Policy available on the Store’s website.
§9 Final Provisions

These Terms and Conditions are governed by Polish law.
-
In matters not regulated herein, the provisions of the Civil Code, the Act on the Provision of Services by Electronic Means, and the Consumer Rights Act apply.

The Terms and Conditions may be amended – any changes will be published 14 days in advance.
-
Any disputes shall be resolved by the competent court in accordance with Polish law.
