§1 General Provisions

 

  1. This Privacy Policy defines the rules for the processing of personal data collected through the Fenix online store operating at: https://fenix-jewellery.com.

  2. The controller of personal data is Fenix Krzyżanowski Krzysztof Edward, with its registered office at ul. Tysiąclecia 9, 80-351 Gdańsk, Poland, Tax ID (NIP): 9570034549, REGON: 191548280.

  4. The Controller makes every effort to protect the privacy of persons visiting the store and to ensure the security of data processing in accordance with applicable legal regulations, including the GDPR Regulation.

 

§2 Scope of Processed Personal Data

 

  1. The Controller may process the following personal data of users:
    • first and last name,
    • e-mail address,
    • phone number,
    • delivery address,
    • invoicing details (including Tax ID, if applicable),
    • IP address,
    • other data voluntarily provided in contact or order forms.

  2. Personal data is collected during:
    • registration of an account in the store,
    • placing an order,
    • contacting the store via the contact form,
    • subscribing to the newsletter (if applicable),
    • using the website (cookies).

 

§3 Purpose and Legal Basis for Data Processing

 

Personal data is processed for the following purposes:

  1. Conclusion and performance of a sales contract (based on Article 6(1)(b) GDPR),

  2. Fulfilment of legal obligations imposed on the Controller, e.g., those arising from tax and accounting regulations (Article 6(1)(c) GDPR),

  3. Establishment, exercise or defence of legal claims (Article 6(1)(f) GDPR),

  4. Marketing of own services and products (Article 6(1)(f) GDPR),

  5. Handling enquiries and customer communication (Article 6(1)(f) GDPR).

 

§4 Disclosure of Personal Data

 

  1. Personal data may be disclosed to entities processing data on behalf of the Controller, including:
    • courier and logistics companies,
    • payment operators (e.g., PayU, Przelewy24, Shopify Payments),
    • IT and hosting service providers,
    • accounting office.

  2. All entities processing personal data act on the basis of data processing agreements.

  3. Data is not transferred to third countries or international organisations.

 

§5 Data Retention Period

 

  1. Personal data is retained for the period necessary to perform the contract and until the expiration of potential claims, as well as for the period required by law (e.g., tax regulations – typically 5 years).

  2. In the case of data processed based on consent (e.g., newsletter), data will be processed until consent is withdrawn.

Every person whose data is processed has the right to:

  2. rectify (correct) data,

  3. delete data ("right to be forgotten"),

  4. restrict data processing,

  5. transfer data to another controller,

  6. object to the processing of data,

  7. lodge a complaint with the President of the Personal Data Protection Office (UODO).

  1. The store uses cookies to ensure the correct functioning of the website, facilitate the use of the store, and compile statistics.

§8 Final Provisions

 

  1. The Controller reserves the right to introduce changes to this Privacy Policy. The current version of the document will always be available on the store's website.

  2. In matters not regulated by this policy, the relevant provisions of Polish law and the GDPR apply.
